No Win - No FeeIf we agree to take your case on a conditional fee (“no win, no fee”) agreement, you will not have to pay us for our time if you lose. If you win at trial or the case is settled, our fees and disbursements will normally be paid by your opponent on top of the amount you receive as compensation for your injuries and financial losses.
If you have to issue proceedings against your opponent and you lose, you would normally be ordered to pay their legal costs which can be substantial. In order to protect you from this, we arrange an insurance policy which pays the other side's costs in these circumstances. The policy also reimburses us for the disbursements – such as medical report fees and court fees – which we have to pay out for you during the course of your case. The premium for the policy is not paid until the end of the case and only if you win (in which case your opponent will have to pay it).
Because we take the risk of not being paid at all if you lose, your opponent has to pay us a "success fee" which is an additional percentage on top of our normal fees for the time we have spent working on your case. The success fee is not based on the amount of your damages. It is higher in risky cases than in more straightforward ones. However, if we set a high success fee, it does not necessarily mean that we do not think your case is likely to succeed, simply that it may be difficult or that we do not yet have a lot of evidence for us to be confident that you will definitely win so we are taking a bigger risk.
This all means that if you lose, it won’t cost you a penny. And when you win, the other side will pay us and you will get 100% of your compensation |
